Notice of Privacy Practices

You may request an electronic or paper copy of your medical record and other health information CuraNow Health maintains about you.

We will provide access or a copy as required by applicable law. A reasonable, cost-based fee may apply when permitted by law.

If you believe health information in your medical record is incorrect or incomplete, you may ask us to correct it.

We may deny your request in certain circumstances, but we will explain the reason when required.

You may ask CuraNow Health to contact you in a specific way or at a particular location.

For example, you may request that we communicate with you through a particular telephone number or mailing address.

We will accommodate reasonable requests as required by law.

You may ask us not to use or share certain health information for treatment, payment, or healthcare operations.

We are not required to agree to every request.

If you pay for a healthcare service or item completely out of pocket, you may ask us not to disclose information about that service to your health plan for payment or healthcare operations. We will honor the request when required by law unless disclosure is otherwise required by law.

You may request an accounting of certain disclosures of your health information.

The accounting generally covers disclosures made during the six years before your request, subject to exceptions under applicable law.

You may request a paper or electronic copy of this Notice of Privacy Practices at any time.

If you have given someone medical power of attorney or another person has legal authority to act on your behalf, that person may exercise your privacy rights as permitted by law.

We may verify that person's authority before taking action.

If you believe your privacy rights have been violated, you may submit a complaint to CuraNow Health.

You may also file a complaint with the U.S. Department of Health and Human Services Office for Civil Rights.

CuraNow Health will not retaliate against you for filing a privacy complaint.

We may use and share your health information to provide, coordinate, or manage your healthcare.

For example, we may share appropriate information with pharmacies, laboratories, imaging facilities, specialists, hospitals, and other healthcare providers involved in your care.

We may use and disclose health information to bill and receive payment for healthcare services.

This may include sharing appropriate information with your health insurance company or other payer to determine eligibility, obtain payment, or process claims.

We may use and share health information to operate CuraNow Health and improve the healthcare services we provide.

Examples may include quality improvement, patient safety activities, credentialing, compliance, auditing, and business administration.

CuraNow Health may use vendors and service providers that perform functions involving protected health information on our behalf.

When required by HIPAA, these organizations are considered business associates and are required to appropriately safeguard protected health information.

We may disclose health information for certain public-health and safety activities when permitted or required by law.

Examples may include reporting certain diseases or conditions; preventing or reducing a serious threat to health or safety; reporting suspected abuse, neglect, or domestic violence when required or permitted by law; and reporting certain adverse events or product-related concerns.

We may disclose your health information when federal or state law requires us to do so.

We may disclose information to authorized health oversight agencies for activities such as audits, investigations, inspections, licensure, and other legally authorized oversight activities.

We may disclose health information in response to certain court orders, subpoenas, administrative proceedings, or law-enforcement requests when permitted or required by applicable law.

We may disclose health information as authorized by and necessary to comply with workers' compensation laws and similar programs.

We may disclose health information to coroners, medical examiners, funeral directors, or other authorized individuals when permitted or required by law.

Certain categories of health information may receive additional protections under federal or California law.

When additional protections apply, CuraNow Health will use or disclose that information only as permitted by applicable law.

This may include certain information relating to mental or behavioral health; substance use disorder treatment; HIV/AIDS and other communicable diseases; genetic information; reproductive or sexual health; and other specially protected health information.

CuraNow Health will follow applicable federal and California requirements governing these records.

Federal law provides additional protections for certain substance use disorder patient records governed by 42 CFR Part 2.

When CuraNow Health receives or maintains information that is subject to these additional protections, we will use and disclose that information in accordance with applicable federal requirements.

CuraNow Health provides certain healthcare services through telehealth.

We use reasonable administrative, technical, and physical safeguards designed to protect health information communicated or maintained electronically.

Patients should provide medical and clinical information only through CuraNow Health's designated secure clinical platform or another communication method specifically directed by CuraNow Health.

Please do not submit symptoms, diagnoses, medications, medical history, laboratory results, photographs of medical conditions, or other sensitive medical information through CuraNow Health's general website forms or regular email.
